Terms of Service
These Terms of Service govern your access to and use of CallerPass websites, mobile applications, protected-number services, call screening, message screening, access codes, trusted contacts, voicemail tools, subscription features, and related services (collectively, the "Services"). By creating an account, starting a subscription, using a protected number, or otherwise using CallerPass, you agree to these Terms.
If you do not agree to these Terms, do not use CallerPass. These Terms should be read together with our Privacy Policy, Acceptable Use Policy, SMS Consent terms, plan details, and any feature-specific notices shown in the app.
1. What CallerPass does
CallerPass is a communication access-control service. It can help you manage who reaches you through protected numbers, trusted contacts, access codes, message requests, voicemail, caller notifications, and related controls. CallerPass is designed to add a privacy and screening layer, not to replace your mobile carrier, emergency calling, or your responsibility for communication decisions.
2. Eligibility and accounts
You must be able to form a binding agreement and may use CallerPass only for lawful purposes. You are responsible for the accuracy of information you provide, for maintaining control of your account, devices, authentication codes, and protected-number settings, and for all activity under your account.
You may not share account access in a way that creates security, billing, fraud, compliance, or telecommunications risk. Tell us promptly if you believe your account or device has been compromised.
3. Protected numbers and communication features
Protected numbers, forwarding, screening, voicemail, message requests, notifications, caller ID, contact links, access codes, and trusted-contact features may depend on third-party telecommunications providers, mobile carriers, app stores, device settings, internet access, and network availability. Delivery, routing, caller identification, notifications, transcription, summaries, and screening results are not guaranteed.
CallerPass may assign, change, reclaim, quarantine, release, suspend, or restrict protected numbers where needed for service operation, nonpayment, account closure, suspected abuse, legal compliance, provider requirements, or operational risk. You do not own protected numbers assigned through CallerPass.
4. Your responsibilities
You are responsible for how you configure CallerPass and for communications you send, receive, approve, block, forward, or otherwise manage through the Services. You are responsible for deciding who to trust, whether to answer or return a call, whether to approve a request, and whether your use complies with applicable laws.
You must not use CallerPass for spam, unlawful telemarketing, harassment, fraud, impersonation, phishing, unlawful recording, stalking, unlawful surveillance, deceptive caller identification, abuse of carrier infrastructure, or any activity prohibited by our Acceptable Use Policy.
5. Subscriptions, billing, and plan changes
Paid plans may renew automatically until canceled. Prices, included usage, limits, overage rules, features, and plan names may change over time. We will provide notice where required by law or where the change materially affects your subscription.
You authorize CallerPass and our payment processors to charge applicable subscription fees, taxes, usage charges, and other amounts associated with your selected plan. If payment fails, CallerPass may limit, suspend, downgrade, cancel, or terminate service and may release or reclaim protected numbers after applicable grace or quarantine periods.
Unless otherwise required by law or stated in a specific offer, fees are non-refundable. App Store, Play Store, Stripe, or other payment-provider purchases may also be subject to that provider's billing and refund rules.
6. Trials, promotions, and early access
CallerPass may offer trials, preview plans, promotional pricing, beta features, or early access features. These may be changed, limited, or discontinued at any time. Beta and early access features may be incomplete, may change without notice, and may not be available to all users.
7. SMS and notification terms
By providing your mobile number and opting in, you authorize CallerPass to send service-related SMS messages related to your account, verification, security, protected calling, protected messaging, contact requests, voicemail, forwarding/setup, billing, and support. Message frequency varies. Message and data rates may apply.
You may reply STOP to supported CallerPass SMS messages to opt out of further non-essential SMS messages from that sender where opt-out is available. You may reply HELP for help or contact support@callerpass.com. Some essential transactional or legal notices may still be sent where permitted or required.
Mobile phone numbers and SMS consent data are not sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. SMS data may be shared with service providers only as needed to operate, deliver, secure, support, and comply with the Services.
8. Emergency services and safety
CallerPass is not a telecommunications carrier, emergency dispatch provider, or replacement for your cellular service. CallerPass is not intended for emergency calling, and you should not rely on CallerPass for 911 or other emergency access. Use your mobile carrier or local emergency services directly for emergencies.
9. Privacy
Our Privacy Policy explains how we collect, use, share, and retain information. By using CallerPass, you acknowledge that we may process account data, phone numbers, call and message metadata, contact/request records, voicemail-related data, device data, billing data, support communications, and security logs as described in the Privacy Policy.
10. Third-party services
CallerPass relies on third-party services including carriers, telecommunications providers, messaging providers, cloud hosting, analytics, authentication, payment processors, app stores, and support tools. We are not responsible for third-party outages, delays, routing failures, provider decisions, unsupported devices, app-store review outcomes, or carrier restrictions.
11. Service changes, suspension, and termination
We may modify, suspend, restrict, or discontinue any part of the Services at any time. We may suspend or terminate accounts, restrict features, block communications, reclaim protected numbers, or preserve records if we believe there is nonpayment, security risk, abuse, fraud, policy violation, legal risk, carrier/provider risk, or harm to CallerPass, users, or third parties.
You may stop using CallerPass at any time. Cancellation does not automatically erase obligations already incurred, and some records may be retained for legal, billing, security, fraud-prevention, dispute, operational, or compliance purposes.
12. Disclaimers
CallerPass is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, and uninterrupted or error-free operation.
CallerPass does not guarantee that communications will always be delivered, that screening will always be accurate, that all unwanted communications will be blocked, that all wanted communications will be received, that forwarding will work with every carrier, or that third-party systems will function without interruption.
13. Limitation of liability
To the maximum extent permitted by law, CallerPass and its affiliates, officers, employees, contractors, agents, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, missed calls, missed messages, forwarding failures, routing failures, security incidents, reputational harm, personal injury, or damages arising from third-party actions.
To the maximum extent permitted by law, CallerPass's total liability for any claim arising from or relating to the Services will not exceed the greater of the amount you paid to CallerPass during the three months before the event giving rise to the claim or one hundred U.S. dollars ($100).
14. Indemnification
You agree to defend, indemnify, and hold harmless CallerPass and its affiliates, officers, employees, contractors, agents, and partners from claims, liabilities, damages, losses, costs, and expenses arising from your use or misuse of the Services, unlawful communications, policy violations, regulatory violations, telecommunications violations, disputes with third parties, or violation of rights or laws.
15. Changes to these Terms
We may update these Terms from time to time. Changes become effective when posted unless a later effective date is stated. Continued use of CallerPass after changes means you accept the updated Terms. If you do not agree, you must stop using the Services.
